A Calgary-based street pastor and others who were accused of breaching a Covid lockdown order have won an appeal against a contempt of court finding.
In a unanimous decision, a three-member Alberta Court of Appeal panel ruled that the order was ‘not sufficiently clear’ so it must set aside the contempt finding.
The court ordered that fines, cost orders, and other sanctions against Artur Pawlowski and his co-defendants be returned to them.
The judges said they do not necessarily condone the actions of the defendants, but the issue at hand is whether the injunction applied to them such as they could be found in contempt of it.
